Relationship between Project Manager and Backers
Black Book provides a Crowdfunding Platform for creative projects. When the Project Developer posts a project on the Game On platform, he invites the Backers to form a contract with him. Any Backer who supports a Project accepts the Project Manager's offer and forms a contract directly with the Project Manager.
Black Book is not a part of this Agreement. This contract is a direct and legal agreement between the Project Manager and their Backers.
Once a project is funded by a Backer, the Project Developer commits contractually to that Backer to complete the project and provide each advertised reward. Once the Project Developer has provided these rewards, they have satisfied their obligation to their Backers.
The Project Managers owe their Backers a high level of quality, honest communication and a commitment to bringing the project to completion.
Backers: breach of contract
- They work with care and good faith to lead the project to the best possible outcome within a reasonable time and expressly communicated with their Backers;
- They are able to demonstrate that they have used the funding in a suitable manner and made all their best efforts to complete the Project under the conditions provided ;
- They issued clear information and made no misrepresentation in their submission to the Backers; and
- They provided repayment of remaining funds to Backers who didn’t received their rewards (as a proportion of pledges), or stated, how these funds will be used to complete the project in another form.
Backing a project
The estimated delivery date depends on the good faith of the Project Manager and is not guaranteed by Black Book. The schedule can change depending on the work to be done by the Project Manager. The Project Manager must notify the Backers of any changes as soon as possible
To deliver the Rewards, the Project Manager may need additional information from the Backers, such as their email addresses or their t-shirt sizes. In order to receive the Rewards, Backers must provide the requested information within a reasonable period of time, by failing they risk not receiving the rewards.
The responsibility for finishing a Project rests entirely with the Project Manager. Black Book does not hold funds on behalf of the Project Manager, cannot guarantee their work and offers no guarantee of reimbursement.
Black Book Liability Release
Black Book does not oversee the performance of a Project and does not intervene in disputes between Backers and Project Manager. Black Book is not responsible for damages or losses related to the use of the Services by Project Owners or Backers. Black Book does not get involved in disputes between Project Managers and the Backers or any third parties related to the use of the Services. Black Book does not oversee the performance or timeliness of Projects, and does not endorse any content submitted by users to the Website. When you use the Services, you release Black Book of claims, damages, and claims of any kind known or unknown, foreseeable or not, disclosed or undisclosed arising out of or in connection with such disputes and the Services. Any content accessed through the Service is at your own risk. You are solely responsible for all loss or damage caused to any party.
